Brazil's Supreme Court Delays Case on Gaming Prohibition

The Federal Supreme Court (STF) of Brazil has suspended a case regarding the criminalization of traditional games. Judge Flávio Dino requested more time to review how the regulated betting framework in Brazil should be addressed in its ruling. This case refers to Article 50 of Brazil's Criminal Misdemeanors Law, which establishes penalties for operating or exploiting unauthorized gambling activities, including jogo do bicho, bingo, and slot machines.

The case originated in Rio Grande do Sul, where a state appeals panel determined that operating a gambling game should no longer be considered a criminal offense. The panel held that the basis for the prohibition established in 1941 conflicted with constitutional principles such as free enterprise and individual freedom. The State Prosecutor's Office appealed, and the STF accepted the case as of general repercussion, meaning its ruling will guide similar cases nationwide.

Debate on the Constitutionality of Article 50

Judge Luiz Fux, the rapporteur of the case, voted in favor of maintaining the constitutionality of Article 50. However, Dino agreed that the prohibition of unauthorized traditional gaming remains valid but argued that the Court should not define the scope of its ruling without considering the legal treatment of regulated online betting.

Dino expressed concern that an STF ruling addressing only the 1941 prohibition could create legal inconsistencies if it does not consider the gaming activities that Congress has permitted and regulated separately. This request halted the hearing before a final ruling could be issued, and no resumption date has been announced.
