FCA Moves to Ban Finches After Financial Misconduct Ruling

The Financial Conduct Authority (FCA) has decided to prohibit Alec Finch and Robert Finch from participating in the UK financial services sector. This decision follows a High Court judgment on 27 September 2023, which found the pair guilty of fraud and misuse of client money while at AFL Insurance Brokers Limited (AFL). However, the Finches have contested the FCA's Decision Notices, taking their cases to the Upper Tribunal. These notices currently reflect the FCA's provisional assessment.

Details of the Misconduct

The judgment found that Alec and Robert Finch misappropriated client funds to cover AFL's operational costs. When attempting to sell AFL, they fabricated financial records to provide a misleadingly positive view of the company's finances. This deception covered up a significant deficit in client money and misled potential buyers, accountants, and auditors.

In response to these actions, a buyer launched High Court proceedings against the Finches in August 2020. Court allegations focused on the fraudulent behaviors of the Finches. The FCA's decision to ban the individuals is a direct response to the High Court's findings, though the final determination awaits the outcome of the Upper Tribunal review.

FCA's Stand on Misconduct

Therese Chambers, joint executive director of enforcement and market oversight at the FCA, emphasized the severity of this case: "The High Court found that the Finches were the driving force behind every part of this serious fraud," she stated. "We will not tolerate serious misconduct and will take action to remove wrongdoers from the industry."

Financial Considerations

Both Finches provided evidence that any financial penalty would cause severe hardship, leading the FCA to forgo fines of £121,200 and £169,800. Despite this, the FCA's stance remains firm on ensuring a fair and robust financial market.

Impact on AFL Insurance Brokers

AFL Insurance Brokers has since been renamed to Ambon Brokers Limited and is no longer authorized by the FCA. The firm's rebranding and loss of authorization reflect the ongoing consequences of the misconduct identified by the High Court.
