Gibraltar Introduces New Guidance on Adult Cautions for Serious Offences

Gibraltar's Ministry of Justice has released new guidance redefining the framework for issuing adult cautions in specified offences. The emphasis is on prosecutions being the rule, with cautions reserved for exceptional circumstances. Prosecution is expected unless the case is exceptionally unusual, determined by a high-ranking police officer and approved by the Director of Public Prosecution.

Key Elements of the New Guidance

The guidance restricts cautions to true exceptions. Generally, a caution cannot be used for:

• Offender admission
• Lack of previous convictions
• Expressions of remorse
• Administrative convenience

Decision-makers must ensure that if a conviction occurs, it should not warrant a custodial sentence or community order. Victims' viewpoints and public interest are crucial factors in this decision.

Prioritizing Victims and Public Protection

Victim's involvement is central. Authorities must seek victims’ views, consider the impact of the offence, and any safeguarding concerns prior to issuing a caution. If a decision opposes a victim's view, it must be justified and documented.

The Minister for Justice, Hon Nigel Feetham KC MP, emphasizes: > "Serious offences should generally proceed to court. Exceptional circumstances and thorough scrutiny apply for a caution."

Limitations on Cautions

There’s a presumption against using cautions for offences involving vulnerable groups, such as children or involving coercion. These cases are meant for courtroom proceedings unless truly exceptional circumstances justify a caution.

• A caution requires a Superintendent’s assessment and DPP consent

Monitoring and Accountability

The new requirements include thorough documentation, victim consultations, and safeguarding considerations. Enhanced supervisory quality checks are mandated. The Royal Gibraltar Police, along with the Director of Public Prosecution, will review these cautions periodically. An annual anonymized report will be provided to the Minister for Justice, reinforcing continuous improvement of practices.
