Proposed Changes to the Gambling Law in Mexico

A legislator from the Morena party in the Congress of Mexico City has proposed amendments to the Federal Law on Games and Draws. These aim to address gambling addiction and establish stricter controls over online gambling. The initiative, presented by Alberto Martínez Urincho, includes new provisions to tackle gambling addiction and add requirements for operators and digital platforms.

Acknowledgment of Gambling Addiction

The proposal formally recognizes gambling addiction as a mental health issue. Health and risk warnings will be introduced on gambling products, alongside measures to prevent minors from accessing gambling services.

New Control Measures

Greater identity verification and restrictions on certain advertising practices are being requested. The Congress of Mexico City indicates that these measures aim to prevent misleading advertising targeted at vulnerable individuals and ban betting on specific events, such as political developments.

Need for Legal Update

Martínez Urincho emphasizes that this initiative is necessary to align Mexican regulations with the expansion of digital gambling. It is estimated that between 4% and 8% of Mexican adolescents may exhibit problematic gambling behaviors, potentially affecting up to 3.9 million people with gambling disorders.

Legislative Process

The proposal does not imply an immediate change in legislation, as it seeks to amend federal law and must go through the relevant legislative process. It proposes amending Article 3 and adding a new Article 1 Bis to the Federal Law on Games and Draws. This comes amid the expansion of online gambling in Mexico, particularly concerning the protection of minors, advertising, and responsible gambling.
