Polymarket Self-Certifies Arrest and Pandemic Markets
Polymarket introduces arrest and pandemic markets; the certification process is discussed in Congress.

Polymarket has introduced markets allowing users to bet on arrests and pandemics. The platform self-certified on Tuesday, coinciding with a congressional hearing on the robustness of the certification process. According to documents submitted to the Commodity Futures Trading Commission (CFTC), a "qualified arrest" occurs when a person is physically taken into custody within a jurisdiction, meeting certain legal criteria. However, only those taken into custody can constitute a winning bet.
Arrest Markets on Polymarket
On the international Polymarket platform, several arrest markets already exist, including figures like Benjamin Netanyahu, Barack Obama, and YouTuber Reckless Ben. Additionally, a broad market is offered on who will be arrested in 2027, which has already attracted over $200,000 in transactions.
Regulation and Grey Areas
The Commodity Exchange Act (CEA) establishes that markets related to "illegal activity" can be prohibited. The CFTC is reviewing rules to allow sports contracts, despite opposition from state regulators. While arrest markets may be accepted, those focused on crimes are prohibited.
"An event contract that settles on whether a person will commit murder involves illegal activity under state law," explains the CFTC. "In contrast, settling whether Bernard Madoff is convicted of fraud does not involve illegal activity," adds the document.
Certification Process Discussed in Congress
The House Agriculture Committee recently convened to examine consumer protection. Chris Cylke from the American Gaming Association criticized the self-certification process as "unappealable." Carl Kennedy, former general counsel for the CFTC, explained that the process in practice is collaborative and exchanges often seek informal approval before certifying.
Pandemic Markets Under Scrutiny
Polymarket has also self-certified for contracts concerning pandemics. Previously, Polymarket and Kalshi had created markets on Hantavirus. Critics point out that these markets are susceptible to insider trading and manipulation, raising ethical concerns similar to those of war markets.
Future of Polymarket Markets
With the new certification, Polymarket will be able to list pandemic contracts on its previously unregulated U.S. platform by the CFTC. Despite the controversy, they continue to advance in expanding their offerings within a regulatory framework that is under constant scrutiny.
